Georgia Criminal Law

In Georgia, the two main types of criminal charges are misdemeanors and felonies. However, local ordinance violations and traffic tickets can also lead to legal repercussions, although they are not as harsh as misdemeanors and felonies. These can all affect your rights or liberties if they are not correctly defended.

Misdemeanors and Traffic Tickets can carry a maximum sentence of imprisonment for 12 months and a fine of $1000. Judges may either give defendants an opportunity to complete their sentence through probation – instead of going to jail – or suspend a misdemeanor sentence on certain conditions.

However, if you are charged with a misdemeanor of a high and aggravated nature, a conviction can result in a up to one year in county jail and a maximum fine of $5,000. These types of misdemeanors apply to cases with one or more aggravating factors (e.g. crime committed against a family member, elderly person, or disabled individual).

In contrast, felonies are punishable by a prison sentence of at least one year. Instead of having designated felony classes, Georgia assigns sentences for felonies on a case-by-case basis.

The most serious felonies are punishable by life imprisonment or the death penalty. Other serious offenses such as various sex crimes, armed robbery, and kidnapping can carry prison sentences between 10 and 25 years, while less serious felony crimes can lead to shorter sentencing requirements.
