Cherokee County DUI Dismissed (2023)

Our client was involved in a single car accident on her way home in Canton. The officer demanded our client to exit her vehicle and perform field sobriety tests. Our client refused to do any of the officer’s tests. Her refusal to submit to testing led to her arrest based on the officer’s beliefs she was under the influence. She then refused to submit to a blood test. We argued that there was no evidence of intoxication or impairment. Through our arguments, the DUI charge was dismissed.
