Failure to Maintain Lane

Our client was driving at night in an unfamiliar area to an apartment complex. Another car was driving close behind the client’s vehicle. Our client tried to get into the turn lane to turn into the approaching apartment complex. Our client did not realize the trailing car tried to illegally pass him in the turn lane. Our client’s car collided with the rear of the other vehicle resulting in the other car flipping. Our client was given a citation. Our client felt he did not cause the wreck since he was driving appropriately and the other car made an illegal and dangerous maneuver. The prosecutor was reasonable and was convinced that our client should not have been ticketed. The ticket was dismissed.
